THE ON LINE CONFERENCE ON THE TOPIC OF “THE LATEST VERDICTS OF THE ECHR CONCERNING THE REPUBLIC OF ARMENIA” HAS BEEN HELD
16.12.2016 15:22On the 15-th of December in the Chamber of Advocates of RA within the frames of cooperation with the Council of Europe has been held an on line conference on the topic of “The latest verdicts of the ECHR concerning the Republic of Armenia”. From Strasbourg the video-conference was conducted by the experts of the Council of Europe Arevik Stepanyan and Victoria Chernichuk.
During the first part of the conference was presented the statistics and the process of the cases concerning Armenia in ECHR. Was discussed the meaning of the verdicts rendered against Armenia for further judicial practice development. By means of interactive questions and answers thoughts were exchanged concerning the frequently referred to in the practice of ECHR examples of moral damage compensation, as also righteous restitution. The advocates were interested in the peculiarities of terms’ estimation while suing to the ECHR, in case if the principle of legal certainty has been violated.
The second part of the video conference was mainly reverted to the issues concerning righteous trial, especially to violations most often met in national courts and to the development of ECHR practice in that direction. The participants of the conference also sent questions referring to the issue of considering the witness’s absence as unavoidable, on grounding the sentence only by the absent witness’s evidence and concerning the approaches of the ECHR on matters of examining balancing facts' proportion. Also a number of questions have been discussed referring to violations occurring during an examination of a witness and a face-to-face examination.
