THE DELEGATION OF THE CHAMBER OF ADVOCATES OF THE REPUBLIC OF ARMENIA PARTICIPATED IN THE EVENTS DEDICATED TO THE 150-TH ANNIVERSARY OF THE ADVOCACY INSTITUTE FORMATION IN THE RUSSIAN FEDERATION

The Chairman of the Chamber of Advocates Ara Zohrabyan and the headmaster of the School of Adocates Simon Babayan participated in Moscow in the events dedicated to the 150-th anniversary of the advocacy institute formation in Russian Federation.
In the frames of jubilee events on the 30-th of September the representatives of 9 countries' advocacy communities - Russia, Belarus, Georgia, Kazakhstan, Kyrgyzstan, Latvia, Litva, Uzbekistan, Armenia agreed about possible directions of cooperation, as also discussed the possibilities of adocates' activity standardization in legal proceedings cases on criminal matters.
During the round table discussion the Chairman of the Chamber of Advocates of the Russian Federation Yuri Pilipenko emphasized the importance of the foreign colleagues experience, noting that especially for the advocates of post soviet countries is of a great importance to deepen the sphere of cooperation, as brought about by the same past they often come across  similar problems. In this sense he considered finding joint solutions to be a more productive and beneficial working process.
He informed the present ones that for the Russian advocacy society an up-to-date issue is the regulation of advocate's participation in the legal proceedings on criminal matter, that 70% of advocates working in the Federation are specialized on criminal matters. At the same time the latter informed that some Russian advocates suggested to realize the mentioned regulation by means of standardizing the activity of the advocate who appears in a criminal case, and to the judgment of the participants had been presented the project of the standard. According to the suggested standard, the advocate on a criminal case is obliged to realize actions of certain volume.
In the result of professional discussions had been sounded different points of view.
The representatives of the Chamber of Advocates of the Republic of Armenia announced negative attitudes concerning the standardization of advocacy, noting that each criminal case is peculiar and in case of standardization can be limited the possibility of the advocate to act freely while defending his defendant's rights, consequently, following the standards is a risky and at the same time sensitive question and can have unforeseen after-effects.
The delegation of the Chamber of Advocates of Kazakhstan also presented a negative opinion concerning the standardization.
In the frames of the discussions the delegation of the Chamber of Advocates of the Republic of Armenia presented the experience of the Chamber of Advocates of RA in the sphere of public defence, the peculiarities of the Public Defender's office functions and its efficiency.
The representatives of other countries' advocacy societies as a matter of fact complained of the models of free legal help provision in their countries, showing interest in the institute of Public Defender.
At the end of the meeting the participants came to the previous agreement to hold the CIS and Baltic countries second joint meeting in the spring of 2017 in Georgia. In the agenda of the Second international professional meeting will be discussed the advocate's activity, the international approaches to client's defence and other issues connected with the sphere.
